Phil Mistry

Phil Mistry holds two masters in Photography, an MA and MFA (Master of Fine Arts) from SUNY (State University of New York) at New Paltz. He started one of the first digital camera classes in NYC in the middle 90’s at New York’s prestigious ICP (International Center of Photography) where he was an adjunct faculty and also taught Photoshop.

The New York Press Photographers Association as well as the Metro Chapter of the National Press Photographers Association have invited Phil to conduct workshops for their members. Lecturing on digital photography has taken him to various places from the Arizona Newspaper Association to LaGuardia College in NYC. He has freelanced for the New York Post and worked in the photo dept. of The Star Ledger in New Jersey. His specialty is Photojournalism and Electronic Imaging.

Phil helped set up the Digital Photography showroom at B&H Photo-Video, where he trained sales staff and buyers on digital photography. He has been interviewed on CNN and CNBC on the growing popularity of digital cameras. During Operation Desert Storm he found himself in Saudi Arabia running a photo company for a year. Phil has been managing and teaching Popular Photography’s Digital Days workshops since they started in 2003. He currently lives in Birmingham, Alabama where he is trying to finish one more Masters this time in Art History. His wife wants to know, why?

TERMS AND CONDITIONS FOR PARTICIPATION

IN THE POPULAR PHOTOGRAPHY/AMERICAN PHOTO

WORKSHOPS

By indicating yes, you signify that you agree to the following terms and conditions for participation in the Popular Photography/American Photo workshop (hereinafter the "Workshop" or "Workshops").

  1. Basic Cost. The basic cost of the Workshop includes one day of shooting and instruction with professional photographers and lunch . All other expenses, including, without limitation, transportation and hotel, trip extensions, tips and items of a personal nature such as laundry, alcoholic beverages, passport and visa fees, insurance, and foreign port taxes, are not included in the basic cost and are your sole responsibility.
  2. Insurance. If you are traveling to attend a Workshop, unless you are already covered under an existing policy, we recommend that you consider purchasing travel insurance. Such insurance often provides coverage for losses suffered in the event of trip cancellation and interruption, travel delay, loss of baggage and travel documents, baggage delay, medical emergencies and accidental death. We do not assume any obligations or liabilities in connection with travel insurance or will losses suffered as a result of travel cancellation, interruption, delay, etc.
  3. Travel. You understand that there are factors that may impact the Workshop that are beyond our reasonable control. You should build some flexibility into your schedule in case we need to extend the length of the Workshop or make other reasonable scheduling changes to accommodate unanticipated events. You will not be entitled to a refund in the event of unanticipated events requiring scheduling changes. You further agree to hold us harmless from and against any liability for injury, death, damage, loss, accident, delay or irregularity that might occur in connection with any travel, lodging or other services provided by third parties.
  4. Cancellations. There is no cancellation fee if you notify us of your cancellation prior to 15 days. Later cancellations are subject to the following fees: 14-8 days the cancellation fee is 50%; 7-0 days the cancellation fee is 100% of the cost of the event
  5. Release and Waiver of Liability. In consideration of your participation in the Workshop, you promise not to sue and hereby release Popular Photography, American Photo, Hachette Filipacchi Media U.S., Inc., sponsors, all photographers participating in the Workshops, and their respective parents, subsidiaries, affiliates, directors, officers, employees, agents or representatives ("Releasees") from and against any and all liability to you, your personal representatives, assigns, heirs and next of kin for any loss or damages and any claims or demands therefor arising in connection with your participation in the Workshop, including, without limitation, those arising out of injury to your person or property or resulting in your death. You further agree that the foregoing Release and Waiver of Liability is intended to be as broad and inclusive as is permitted by law and that if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect.
  6. Photography. You hereby grant us the following rights in the photography taken by you during the Workshop: (a) the right to publish the photography in Popular Photography and American Photo Magazines, including the right to reproduce and distribute the photographs in their entirety together with all or substantially all of the text of the Magazine at any time in any current or future media, including, without limitation, electronic databases and other collective works; (b) the right to use and reuse the photography on Web sites operated under the Popular Photography, American Photo; (c) the right to authorize republication of the photography in foreign editions of the Popular Photography and American Photo magazines; (d) the right to include the Photography in any video or other recordings of the Workshops; and (e) the right to use the photography for promotional purposes for Popular Photography and American Photo Magazines. You further promise that the photography you take during the Workshop will be of your own creation and will not be libelous or obscene or otherwise violate or infringe the rights of any third party. If we publish your photography, you shall receive a credit, the placement, size and typeface of which shall be in our sole discretion.
  7. Use of Name and Likeness. You also grant us the right to use your name and likeness in connection with the publication, advertising and promotion of Popular Photography and American Photo Magazines, the Workshops and on and in connection with any video or audio recordings of the Workshops. Without limiting the foregoing, you understand and agree that the event may be videotaped and you hereby give us the right and permission to use and permit other to use your image as it appears on the videotape and any statements made by you thereon for editorial and promotional purposes in any format or media currently in existence of hereafter developed in which we may decide to use it. You hereby waive any right to inspect or approve the videotape and its eventual use.
  8. Miscellaneous. You agree that no oral representations, statements or other inducements apart from the foregoing written above have been made. This Agreement shall be governed by the laws of the State of New York applicable to contracts entered into and performed entirely therein. This Agreement sets forth our entire understanding and may not be modified except in a writing signed by you and us.
